IN-HOUSE LABOR & EMPLOYMENT COUNSEL

REPORTS TO:

Eugene J. Berardi, Jr., President & CEO

Bruce I. Kopf, Senior Vice President, Chief Operating Officer & Counsel

PAY RANGE:

$140,000 - $150,000

Pay will be commensurate with experience. This salary range represents the company's good-faith and reasonable estimate of the range of base compensation for the position and does not include performance- or merit-based bonuses including variable compensation or other benefits offered by the company. Actual compensation will depend on a number of factors, including but not limited to the candidate's years of experience and qualifications.

POSITION DESCRIPTION :

Trailways of New York (Adirondack, Pine Hill, and New York Trailways) operates over 150 trips per day to more than 140 destinations in New York, New Jersey, and Canada. POSITION SUMMARY:

Trailways of New York seeks a Labor & Employment attorney to join its team as in-house counsel. Reporting directly to the President & CEO of Trailways of New York, this pivotal role will provide strategic direction and counsel for the company's labor relations, employee relations, and human resource policy functions. The selected candidate will be responsible for (informal) mediation, negotiation, and dispute resolution; human resources oversight; personnel management; and administration of matters consistent with terms and conditions of procedures set forth in collectively bargained agreements and within the federal and State regulatory framework to which the company is subject as an interstate motor carrier.

KEY RESPONSIBILITIES:

This position will provide counsel, support, and oversight in the following areas:

  • Negotiation, interpretation, and application of eight collective bargaining agreements
  • Oversight and administration of human resource policies including:
    • Annual sexual harassment and other mandatory trainings
    • Agency submissions (EEOC/AA, SSPP/PTASP, Emergency Response Plans, etc.)
    • Hiring, onboarding, and orientation materials
    • Drafting disciplinary, discharge, and counseling letters
    • Drafting, reviewing, and revising record retention and other company/departmental policies and memos
    • Federally regulated drug and alcohol testing procedures and related programs
  • Management of outside legal counsel including litigation management and managing Canadian outside counsel related to operations in Montreal and Ontario
  • Legal counsel and drafting/reviewing all correspondence related to Operations, Safety, Fleet Maintenance, and Customer Care Departments
  • Triennial submissions and federal and state triennial audits
  • Regulatory waivers (i.e. FMCSA, FTA)
  • Contract review including insurance indemnification clauses
  • Collaboration on cybersecurity and technology/data privacy requirements
  • Insurance litigation and management of insurance company-appointed counsel
  • Drafting various correspondence as needed

POSITION REQUIREMENTS:

Legal Expertise: Candidates with at least three years of relevant Labor & Employment Law experience will be considered. Prior experience negotiating and administering collective bargaining agreements preferred. Training will be provided.

Familiarity with New York City, New York State and federal labor and employment laws, including: NLRA and NLRB, FMLA, ADA, Civil Rights Act Titles III, VI and VII and NYS PFL required.

Interpersonal: Qualified candidates will possess strong analytical and problem-solving skills, excellent written and verbal communication abilities, a high degree of attention to detail, and will be highly organized, resourceful, and self-sufficient. The ideal candidate will be collaborative and strongly disposed towards conflict resolution rather than confrontation.
